Terms of Service

Eligibility

You must be legally capable of entering into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

Accounts and authentication

Some Services may require an account or allow you to authenticate with Google or another third-party identity provider. You are responsible for keeping your account secure, for maintaining accurate account information, and for activity conducted through your account. Notify us promptly if you suspect unauthorized use.

Your use of a third-party identity provider is also governed by that provider's terms and privacy practices.

Acceptable use

You may not use the Services to:

• violate applicable law or the rights of others;
• distribute malware or facilitate phishing, fraud, or abuse;
• gain or attempt to gain unauthorized access to accounts, systems, or data;
• disrupt, overload, probe, scan, or test the vulnerability of the Services except with our prior written permission;
• evade usage limits, security controls, or access restrictions; or
• use the Services in a way that materially interferes with other users' use of them.

Your content

You retain ownership of content you submit to the Services. You grant us a limited, worldwide, non-exclusive license to host, copy, process, transmit, and display that content only as reasonably necessary to provide, secure, and improve the Services or comply with law. You are responsible for your content and must have the rights needed to provide it to us.

Open-source software

Software we publish under an open-source license is governed by the applicable license and repository documentation, not these Terms. These Terms apply to OwlFoundry-operated websites and hosted services; they do not govern third-party or self-hosted deployments of our open-source software.

Our rights

The Services, including their design, branding, and content provided by us, are owned by OwlFoundry or its licensors and are protected by applicable intellectual property laws. Except for rights expressly granted under these Terms or an open-source license, we reserve all rights.

Third-party services

The Services may link to or interoperate with third-party services. We do not control those services and are not responsible for their content, availability, or practices. Your use of third-party services is governed by their own terms.

Service changes and availability

We may modify, suspend, or discontinue any part of the Services. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. We may establish or change reasonable usage limits to protect the Services and their users.

Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, fail to pay applicable fees, or if continued access would harm the Services or others. Where reasonably practicable, we will provide notice and an opportunity to resolve the issue.

Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available." OwlFoundry disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, OwlFoundry and its contributors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities, arising from or related to the Services or these Terms.

To the maximum extent permitted by law, OwlFoundry's total liability for all claims arising from or related to the Services or these Terms will not exceed the greater of the amount you paid us for the Services during the 12 months before the event giving rise to the claim or US$100. These limitations do not apply where prohibited by law.

Changes to these Terms

We may update these Terms from time to time. We will publish the updated Terms on this page and revise the effective date. If a change is material, we will provide additional notice when reasonably practicable. Your continued use of the Services after updated Terms take effect means you accept them.

General

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a reorganization, merger, acquisition, or sale of assets. These Terms, together with any service-specific terms, form the entire agreement between you and OwlFoundry regarding the Services.
